Through a bill, the PSD (Social Democratic Party) proposes criminalising the conduct of those who invade or occupy a home, providing for sentences of up to two years in prison or a fine. These penalties would be increased in situations where violence is used, the home is owned and occupied permanently, or there is an intention to generate profit.

The Social Democrats want attempted home invasions to also be punished.

This bill received a vote in favour of the PSD, CH, PS, IL, and CDS-PP, an abstention from the JPP, and a vote against from Livre, PCP, BE, and PAN.

The IL bill wants to allow those who illegally occupy third-party properties to be evicted within a maximum period of 48 hours.

The Liberals want "violation of a home and usurpation of real property" to be added to the set of crimes provided by law (such as threats, coercion, or stalking) that currently allow a judge to force criminals to leave their homes.

The party insists, as it did at the end of the previous legislature, on increasing the penalties for these crimes, proposing that illegal occupation of a home be punishable by three years in prison (currently one year) and that if the occupation is carried out with the use of violence, the punishment be increased from three to five years.

The IL also wants the police to be able to identify anyone "in a private place, in the case of violation of a home and usurpation of real property," when the law currently only allows such identification in public places open to the public.

This bill was approved, despite votes against from the PS, Livre, PCP, BE, PAN, and JPP parties.

Chega also proposes giving a 48-hour period to vacate the property, or immediately in the event of a flagrant offence.

The party wants these cases to be judged in summary proceedings and to increase the penalties for those who illegally occupy a home, providing for a sentence of up to three years, or a fine, which can extend to up to five years in prison in cases involving the use of violence.

Chega intends for these penalties to only be increased "by one-third, at their minimum limit," when the conduct "is committed with the intention of obtaining financial gain for oneself or a third party, or when the crime is committed jointly by two or more people."

This bill received votes against from the PS, Livre, PCP, BE, and PAN and a vote against from the JPP. The other parties voted in favour.

A CDS resolution was also approved, recommending the government take "urgent legislative measures to expedite the eviction of illegal occupants, including the establishment of mechanisms for immediate eviction in cases of flagrant violation."

The centrists also call for strengthening the resources of the Judiciary and Internal Administration "to ensure an effective, swift, and proportional response to the gravity of property rights violations," as well as "awareness campaigns that deter illegal practices and restore citizens' trust in the Democratic Rule of Law."
